What is Workers' Compensation?
State law requires that every employer carry insurance for employee injuries, disabilities and illnesses caused by their job. Their coverage costs the employee nothing. It does not matter if the employee caused the injury. If the injury, illness or disability occurs because of your job, you qualify for compensation. Injuries can occur after a single event, such as a fall or collision, or from repetitive stress injuries caused by repeating a certain action continuously throughout the day.
What Are Workers' Compensation Benefits?
Temporary Disability Compensation
Workers unable to work for more than three calendar days due to an injury may apply for a temporary disability benefit. You may receive up to two-thirds of your average weekly earnings for time lost to injury, paid every two weeks up to a set maximum for a set period within five years of the injury.
Permanent Disability Compensation
A permanent disability is an injury or illness that limits your ongoing ability as a worker, making it difficult for you to get a job in the career of your choice. Your age and occupation, and the nature of your disability, factor into your benefit. Obviously, clients and the insurer often disagree about claims for permanent disability. While the insurance company may see no disability, you likely feel completely different. In these moments, the experience of Farrell, Fraulob & Brown is extremely valuable to our Elk Grove clients in making a successful claim.
Medical Treatment for Workplace Injuries
State of California law requires the employer to authorize medical treatment within one day of an employee filing a claim form. Treatment must be provided until the claim is accepted or rejected, with a limit of $10,000 in total.
If your claim is accepted, however, the insurance company must pay for all approved medical care that is supported by evidence-based treatment guidelines. You are not responsible for paying any bills or co-payments. (There are limits, however, on the number of chiropractic, occupational therapy or physical therapy visits provided.) All treatment requests may be reviewed by your insurer and possibly denied. Again, Farrell, Fraulob & Brown are extremely concerned that our Elk Grove clients get the medical treatment they need.
Workers’ Compensation Death Benefits
In the unfortunate event of a work-related death, Farrell, Fraulob & Brown works for the family of the employee to ensure they receive what they deserve in this time of need. The number of dependents the employee cared for and the salary at the time of the injury determine the amount of the death benefit. Obviously, these amounts can be considerable and our attorneys realize that they are very important to the health and welfare of the families of our clients.
